These Terms of Service (“Terms”) govern your access to and use of our service marketplace platform (the “Platform”) that connects customers (“Customers”, "you") with professional technicians (“Technicians”) for various home and office services, including but not limited to furniture assembly, TV and wall mounting, and installation services. By using our Platform, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Platform, you signify that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Services Offered

Help and Handy connects Customers with qualified Technicians for the following services:

  • Furniture Assembly
  • TV and Wall Mounting
  • Installation Services

3. User Responsibilities

3.1 Customer Responsibilities

  • Provide accurate information during registration and service requests.
  • Ensure the location for service is accessible and safe.
  • Communicate any special requirements or concerns to Technicians prior to the service.
  • Make payment according to the agreed terms.

3.2 Technician Responsibilities

  • Provide services in a professional and timely manner.
  • Maintain necessary licenses and certifications, if required by law.
  • Communicate effectively with Customers regarding service details and completion.

4. Online Booking and Payment Processing

Customers can book services via the Platform. Payment for services is processed through Stripe. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

5. Pricing Structure

Help and Handy utilizes a flat-rate pricing structure for all services offered. Pricing details will be clearly stated on the Platform before booking confirmation.

6. Cancellation and Rescheduling Policy

Customers may cancel or reschedule a booked service appointment up to two (2) hours before the scheduled time without incurring any penalty. Cancellations or changes made within this time frame may be subject to a fee as outlined on the Platform.

7. Refund Policy

Refund requests must be submitted within 24 hours of service completion. Help and Handy reserves the right to review refund requests and will process refunds at its discretion. Refunds may take several days to process based on your financial institution.

8. Liability Limitations

To the fullest extent permitted by law, Help and Handy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, services provided by Technicians, or any interactions with other users. Help and Handy's liability for any claim related to these Terms shall not exceed the amount paid by you for the service giving rise to the claim.

9. Dispute Resolution

In the event of any dispute or claim arising out of or relating to these Terms or your use of the Platform, you and Help and Handy agree to resolve the dispute informally. If the dispute cannot be resolved informally, we agree to submit it to binding arbitration in accordance with the rules of the American Arbitration Association in the State of New York.

10. Account Termination

Help and Handy reserves the right to suspend or terminate your account for any violation of these Terms or any illegal activity. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform will cease, and you will remain liable for any outstanding payments.

11. Intellectual Property Rights

All content, trademarks, and other intellectual property on the Platform are owned by Help and Handy or our licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not copy, reproduce, or distribute any materials without prior written consent from Help and Handy.

12. Modifications to Terms

Help and Handy reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.
